食安新制，今年7月起將有5項上路，包括會引發心血管疾病、還會造成肥胖的傷身殺手「人工反式脂肪」禁用令將生效，以製造日期為準，未來食品中不得使用不完全氫化油；而愛美人士追求排便順暢、甚至減肥的茶包、粉末或膠囊食品，也限制原料「番瀉」的使用量及使用部位。違者最高開罰300萬元。

這5項食品管理新制分別如下：

1.食品原料「番瀉」使用限制、加註警語

包括限制番瀉使用部位為新鮮或直接乾燥之葉及莢，不得經萃取等其他加工處理，且僅限用於茶包，供沖泡飲用，其產品所含番瀉?（sennosides）每日使用量不得達12毫克。

另使用番瀉的產品外包裝應標示「番瀉?含量」、「本品可能導致腹瀉」、「於晚上食用一次，一星期不得食用高於三次，欲連續食用超過一星期須先諮詢醫師意見」及「有慢性腹瀉、腸阻塞、腸狹窄、乏力、炎症性結腸疾病（如克隆氏症、潰瘍性結腸炎）、闌尾炎、不明原因腹痛伴隨水及電解質缺乏、嚴重脫水或是慢性便祕者，以及孕婦、授乳婦女及未滿十歲兒童不宜食用」或等同意義字樣之警語。

若不符合前述規定者，得依食品安全衛生管理法規定處3萬元以上、300萬元以下罰鍰。

2.全面禁用食用氫化油

自107年7月1日（以製造日期為準），食品中不得使用不完全氫化油，違反者將依據食品安全衛生管理法第48條，經命限期改正，屆期不改正者，處3萬元以上300萬元以下罰鍰。

規定食品中不得使用不完全氫化油或稱部分氫化油(Partially hydrogenated oils，PHOs)」，並自107年7月1日正式施行(製造日期為準)。

3.包裝食用醋正名

要求以釀造食醋為原料，添加其他原料製成的調理食醋，應於包裝明顯處加註「調理」字樣；以醋酸或冰醋酸之稀釋液添加糖類、酸味劑、調味劑及食鹽等製成之調味液或以此調味液添加釀造食醋混合而成的合成食醋，應於包裝明顯處加註「合成」字樣。

調理食醋或合成食醋如未依規定標示，標示不完整，可處3萬元以上、300萬元以下罰鍰；標示不實最重可處400萬罰鍰。

4.旅館業附設餐廳應符合食品安全管制系統準則

要求國際觀光旅館內附設餐廳實施HACCP，並擴大要求經交通部觀光局「星級旅館評鑑計畫」評鑑為五星級旅館附設餐廳實施HACCP，

另規範設有餐飲的五星級旅館業自107年7月1日至少應置專門職業人員（食品技師或營養師）一名。

未依規定實施並符合HACCP之業者，將依食安法規定，經命其限期改正，屆期不改正者，處6萬元以上、2億元以下罰緩；情節重大者，並得命其歇業、停業一定期間、廢止其公司、商業、工廠之全部或部分登記事項，或食品業者之登錄；經廢止登錄者，一年內不再申請重新登錄。laennec未依規定設置專門職業人員之業者，處3萬元以上、300萬元以下罰鍰。

5.食用油脂、罐頭食品及蛋製品食品工廠應符合食品安全管制系統準則

公告訂定「食用油脂工廠應符合食品安全管制系統準則之規定」、「罐頭食品工廠應符合食品安全管制系統準則之規定」及「蛋製品工廠應符合食品安全管制系統準則之規定」，確保食用油脂、罐頭食品及蛋製品衛生安全，以提升產業建立衛生及安全管理系統能力，自107年7月1日起分階段實施。
食品安全管制系統稽查不符合的食品業者，可依食安法第44條，經命其限期改正，屆期不改正，處6萬元以上、2億元以下罰鍰。

If it does not meet the above requirements, it may be fined more than 30,000 yuan and less than 3 million yuan according to the Food Safety and Health Management Law.

2. Completely ban edible hydrogenated oil

Since July 1, 107 (subject to the date of manufacture), incompletely hydrogenated oil shall not be used in food. Violators will be corrected according to Article 48 of the Food Safety and Health Management Law, and will not be corrected within the time limit. More than 10,000 yuan and less than 3 million yuan.

It is stipulated that incompletely hydrogenated oils or partially hydrogenated oils (PHOs) shall not be used in foods and shall be officially implemented on July 1, 107 (the date of manufacture shall prevail).

3. Packing the name of edible vinegar

It is required to use the brewing vinegar as raw material and add other raw materials to prepare the vinegar. The words “conditioning” should be added to the packaging. The addition of sugar, sour, flavoring and salt in the dilution of acetic acid or glacial acetic acid. The synthetic vinegar mixed with the seasoning liquid or the vinegar mixed with the seasoning liquid should be marked with the word "synthesis" in the packaging.

If the vinegar or synthetic vinegar is not marked according to the regulations, the label is incomplete and can be fined more than 30,000 yuan and less than 3 million yuan; the label is untrue and the fine is 4 million fines.

4. The restaurant in the hotel industry should comply with the food safety control system guidelines

It is required to implement HACCP in the restaurant of the International Tourist Hotel, and expand the request to implement HACCP for the five-star hotel attached restaurant by the “Star Hotel Evaluation Program” of the Tourism Bureau of the Ministry of Communications.

In addition, the five-star hotel industry with food and beverage shall be regulated. At least one professional staff (food technician or nutritionist) shall be placed on July 1, 107.

Those who fail to comply with the regulations and comply with the HACCP will be ordered to correct within a time limit according to the provisions of the Food Safety Law. Those who do not correct the situation will be sentenced to a penalty of more than 60,000 yuan and less than 200 million yuan; if the circumstances are serious, they will be killed. Closed or closed for a certain period of time, abolish all or part of the registration of the company, business, and factory, or the registration of the food industry; if the registration is abolished, the application will not be re-registered within one year. Those who have not set up professional occupations according to the regulations shall be fined more than 30,000 yuan and less than 3 million yuan.

5. Edible oils, canned foods and egg products food factories should comply with food safety control system guidelines

The announcement states that "the edible oils and fats factories should comply with the requirements of the Food Safety Control System", "the canned food factories should comply with the requirements of the Food Safety Control System" and "the egg products factories should comply with the Food Safety Control System Guidelines" to ensure their consumption.
